PUTRAJAYA, April 16 (Bernama) -- The Federal Court here today upheld the one-year jail sentence on former imam Hoslan Husin who was found guilty of contempt of court for throwing his shoes at a Federal Court bench.
A five-man panel chaired by Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum unanimously dismissed his application to review the decision of the Federal Court's previous panel which found him guilty and sentenced him to a year's jail.
Justice Malanjum said Hoslan's application was for a review under Rule 137 of the Rules of the Federal Court 1995 where there was a requirement in law for Hoslan to pass the threshold to show issue of injustice for his review application to be allowed.
"Unfortunately, the threshold has not been crossed. There is no legal impediment of the previous Federal Court panel," he said in disagreement with the submission by lawyer Tommy Thomas, representing the Malaysian Bar, that the previous three-man Federal Court panel whom Hoslan had hurled his shoes at, was not the proper panel to hear his contempt matter.
Federal Court judge Tan Sri Abdull Hamid Embong, Datuk Ahmad Maarop, Datuk Zainun Ali and Datuk Seri Sulong Matjeraie were the other four judges presiding on the panel.
