High court orders Amizudin to face contempt of court hearing on March 2

By M.MAGESWARI

KUALA LUMPUR: The High Court has ordered blogger Amizudin Ahmat to appear on March 2 for contempt of court proceedings over a defamation suit filed by Infor mation, Commu ni cations and Culture Minister Datuk Seri Dr Rais Yatim.

Justice Zabariah Mohd Yusof ordered Amizudin to file an affidavit-in-reply for the hearing proper by Feb 10 and to hand over a copy to Dr Rais.

“You must get a lawyer within the time,” the judge told him yesterday.

Amizudin applied to the judge for an adjournment saying that he only received the notice on the matter last Wednesday and that he had never attempted to escape from being served the court papers for the proceedings.

Upon hearing this, Justice Zabariah told Amizudin that she had been informed that Dr Rais’ lawyer was having difficulty serving the papers on him.

She also added that the case was mentioned before her several times.

Amizudin said he was shocked to learn that he had “disappeared” from an appellate court to avoid being served the papers.

Dr Rais’ lead counsel Datuk Seri Dr Muhammad Shafee Abdullah said this was a criminal matter and that they were making an application for the blogger to be sent to prison.

Justice Zabariah then explained to Amizudin that he was accused of breaching a court order, which had issued an injunction preventing him from publishing any similar defamatory words against the plaintiff in his blog.

“That (the injunction) is based on what is agreed between the parties. Because of your own conduct, you are said to have breached a court order,” she added.

Justice Zabariah also asked Dr Rais to reply to the the blogger’s affidavit by Feb 24.

Dr Rais, 70, had filed the application on Nov 10, last year, for a committal order against Amizudin for being in contempt of court.

Dr Rais, who won his defamation suit at the High Court on July 4, last year, had been awarded RM300,000 after the blogger implied that the minister had raped his Indonesian maid.

The Court of Appeal had on last Wednesday upheld the High Court’s decision.

It said that the award was not high in view of Dr Rais’ high social standing.

It, however, reduced the costs from RM100,000 to RM50,000.

Dr Rais filed the suit against Amizudin on Jan 31 last year, saying that the blogger had published a defamatory article under the heading Hei Pak Menteri ... mana mau lari ... (Hey Mr Minister.... where do you want to run to) in his blog on Dec 28, 2010.

Penang BN wants Guan Eng to apologise ovet Tang Hak Ju.

By Aaron Ngui

GEORGE TOWN (Jan20, 2012) : Following a Court of Appeal ruling that the state government was not liable to pay RM 40 million to a businessman in a land case, the Penang Barisan National (BN) is calling upon Chief Minister Lim Guan Eng to apologize for using the case to gain political mileage.

State BN working committee chairman Datuk Dr Teng Hock Nan claimed Lim, along with the other Excos and Pakatan Rakyat (PR) assemblyman had used the
issue, widely reported as the "Tang Hak Ju scam or scandal", to smear the BN's reputation in the state as it happened before PR formed the state government.

He said the Lim's administration should also withdraw words like "scam" and "scandal" when referring to the case as those words had criminal connotations.

"If he (Lim) is man enough, if he walks the talk (which is) being accountable then he should apologize," Teng said at a press conference yesterday but did not set a deadline or give an ultimatum.

The Tang Hak Ju case involved a 10.6 acre quarry site which had been leased to an individual in 2001 but the deal was later cancelled.

The individual had sought RM 1.8 million in compensation but the BN-led state government then refused to pay, leading to legal proceedings in which the court awarded the plaintiff pay RM 40 million including interests.

When PR took over the state's administration, it "unveiled" the issue creating a media firestorm and ultimately a white paper on the matter was
presented to the state assembly in May last year by Deputy Chief Minister II P Ramasamy.

Teng, who revealed that the Court of Appeal verdict which overturned the High Court ruling ordering the state government to pay was made last Wednesday (Jan 11) in Putrajaya, also called upon the white paper to be withdrawn.

He described certain statements in the white paper as vicious and unfair and expressed his disappointment with Ramasamy.

He also explained that the then state government decided not to pay because the plaintiff, did not give a receipt for wanting the payment.

"We ask for receipt, never given any receipt, how are we going to give RM 1.8 million … how can the state government go into agreement with the plaintiff without going through a proper procedure?" he said adding that there was also no proof that the plaintiff had suffered losses.

Teng added that the ruling by the appellate court had also ordered that only RM500,000 in incidental costs was to be paid to the plaintiff, noting that it was some 400 per cent less than the RM1.8million sought.

He said the ruling immediately vindicated and cleared the previous BN-led state government from any wrongdoing and questioned why the state administration had kept quiet over the ruling.

"We had been waiting for the state government (for 10 days) to issue a statement to tell the people but 10 days is too long to wait," he said.

LGE told to apologise

GEORGE TOWN : Penang Chief Minister Lim Guan Eng has been told to apologise to the people for misleading them over the Tang Hak Ju land case in the wake of a Court of Appeal ruling that the state government need not pay RM40 million compensation to the businessman.
State Barisan Nasional working committee chairman Datuk Dr Teng Hock Nan yesterday revealed that the Court of Appeal had, on Jan 11, ruled in favour of the state government and overturned a Penang High Court decision awarding Tang the amount.

Dr Teng said instead of RM40 million, Tang was only given RM500,000 for incidental expenses after the Court of Appeal overturned the High Court decision, which Lim had billed as "the biggest land scam in the history of Penang".

"The decision has vindicated us and cleared us  of any wrongdoing," Dr Teng said in reference to the previous Gerakan-led state government.

"The surprising thing is that Lim has kept quiet about the decision and has not said a word about it although 10 days have passed since the verdict was handed down.

"His silence is deafening and  is completely opposite to all the noise he was making when he went round saying that this was the biggest land scam and scandal committed by the previous state government."

Dr Teng said it was now clear that Lim was just hell bent on politicising and exploiting issues to mislead the people and to paint a negative picture of the previous Gerakan-led administration.

He recalled how the entire state cabinet had been stirring up the issue and making all sorts of accusations just to gain political mileage.

"They even went to the extent of tabling a white paper at the state legislative assembly, despite knowing full well that the case was in the appeal stage.

"The white paper was filled with all kinds of vicious assumptions and accusations.

"They used words like 'land scam' and 'scandal', which has criminal connotations but we waited patiently for the court process and we are now vindicated."

Dr Teng said Lim should  withdraw all  baseless accusations and apologise for misleading the people, as well as withdrawing the white paper report on the case.

The Tang Hak Ju case dates back to 2002  when the businessman applied for a 4.3ha plot of land in Seberang Prai to extract rocks for quarrying purposes.

Tang's application was approved by the authorities.

However, the authorities later cancelled the title issued to Tang in 2004 following complaints from the original landowners -- the Hock Teik Cheng Sin temple and the Hokkien Hoay Kuan Province Wellesley Association.

Tang subsequently sued the state  and the High Court awarded him RM29.36 million, plus interest, dating back to Jan 24, 2005.

After Pakatan took over the state government, Lim and his executive council immediately went on the offensive and called it the biggest land scam in Penang.

Deputy Chief Minister II P. Ramasamy was quoted as saying that the scandal had had a great impact on the present state government as millions had been siphoned off from its coffers.

A white paper on the so-called scam was tabled at the state assembly last year and bulldozed through despite objections from  BN assemblymen.

Robert Ryaid Geneid

ROBERT  RYAID GENEID
WHO IS ROBERT GENEID?  IS HE A FOREIGNER W HO THROUGH HIS  MANIPULATION ON THE STATE GOVERNMENT  CIVIL SERVICE  AND THROUGH HIS INSTIGATION TO THE CHIEF MINISTER BECAME UNDESERVING  BILLIONAIRE?
IS ROBERT  GENEID  A FOREIGNER WHO CUNNINGLY MANAGED TO MANOVEOUR HIMSELF TO BECOME ONE OF THE MOST INFLUENTIAL  UNOFFCIAL  ADVISER TO CHIEF MINISTER?
HOW DID ROBERT GENEID  AND HIS WIFE SUCCEEDED IN GRABBING HUNDRED OF THOUSANDS OF STATE LAND AND BY UNFAIR MEANS BAGGED  MULTIBILLIONS RINGGIT OF STATE and Federal CONTRACTS (at the behest of the state government) ?
HOW DID ROBERT GENEID MANAGE TO HAVE SUCH A  GRIP ON THE CHIEF MINISTER OF SARAWAK?
THE ANSWERS TO ALL THESE QUESTIONS LIE PARLTLY IN ROBERT’S  MARITAL RELATIONSHIP TO THE A SISTER OF THE CHIEF MINISTER, DATUK  RAZIAH MAHMUD. PARTLY DUE TO HIS CLOSE RELATIONSHIP TO HIS WITCH LEBONESE COUSIN, STELLA TASHMAN,  AND PARTLY  BECAUSE HE COULD NOT CONTROL HIS GREED FOR MONEY AND POWER.
HE CAME FROM A POOR FAMILY WHERE HIS MOTHER AND FATHER WERE VEGETABLES SELLER AT THE SYDNEY MARKET IN AUSTRALIA.   ROBERT’S HOUSE IN SYDNEY  WERE 2 BED-BEDROOM BROKEN DOWN DELAPIDATED  ROUH BEAR CONCRETE.  HE TRIED  HIS LUCK BY APPLYING FOR A JOB IN A LAW FIRM IN SINAPORE. HE WAS LATER ASKED TO LEAVE BY THE LAW FOR REASON OF MISAPPROPRIATION OF CLIENT’S FUND.  TO ESCAPE  HE  GOT HIS WIFE TO GET HIM TO WORK IN THE RICH RESOURCED  LAND OF SARAWAK.  THIS WAS THE BEGINNING OF THE SLOW BUT STEADY  DOWNFALL OF THE TAIB’S FAMILY.  HE STARTED INSTIGATING CHIEF MINSTER AND HIS FAMILY  AGAINST  CHIEF MINISTER’S TWO TRUSTED BROTHERS, LATE ARIP AND DATO ONN.  ROBERT WAS SUCCESSFUL IN GETTING TAIB  DISFAVOURING DATO ONN.  WHEN DATO ONN LEFT CAHAYA MATA SARAWAK ROBERT  IMMEDIATELY  BECAME A DIRECTOR IN CMS GROUP. THEN LEFT ONLY DATO ARIP  FOR ROBERT TO TACKLE.  DATO ARIP  OPENLY OBJECTED TO THE DANGEROUS  GAME  OF THE WITCH COUSIN ON THE TAIB FAMILY.   THE DEADLY WORKS OF  ROBERT’S  WITCH COUSIN CAME  TO BE  VERY USEFUL  FOR ROBERT . DATO ARIP WAS OFTEN SICK AND LATER DIED  CAUSED  BY MEDICAL  AND SPIRITUAL  DOING.   SEVERAL REASONS WHY ROBERT  WANTED DATO ARIP OUT OF THE INNER CIRCLE OF TAIB FAMILY.  DATO ARIP SOMETIMES  QUESTIONED ROBERT’S ROLE  ON SOME  OF TAIB’S MAJOR  MISGUIDED  DECISIONS  WHICH NEGATIVELY  AFFECTED  THE PEOPLE OF SARAWAK AND THE STATE GOVERNMENT.   DATO ARIP  WAS ALWAYS PROTECTING TAIB  AND  HE DID NOT  MIND  CONFRONTING  ROBERT  OVER  ROBERT’S OBSTRUSIVE INTERFERENCES IN TAIB’S  DECISIONS MAKING. ROBERT OR RAZIAH WOULD ORGANISE  ROBERT’S WITCH COUSIN TO DO  SESSIONS WITH TAIB  WHERE TAIB WOULD ASK QUESTIONS ON STATE, FAMILY  AND BUSINESS MATTERS.  AT THAT TIME DATO ARIP WAS TAIB’S  FEW SANE and Righteuos PILLARS.  FOR EXAMPLE,  WHEN HE RECEIVED COMPLAINS  FROM  MANY CHINESE BUSINESSMEN WHO CLAIMED  ROBERT  TOOK SUBSTANTIAL SUM OF  MONEYFROM  THEM PROMISING  THEM HE WOULD  GET TAIB TO GIVE HIM WHAT HE WANTED,  DATO ARIP WOULD CONFRONT AND SORTED ROBERT OUT.  DATO ARIP OFTEN FOUGHT WITH DATO ROBERT OVER HOW ROBERT MISMANAGED THE RYGA HOTEL (NOW MARRIOT ) IN MIRI AND HOW ROBERT GOT THE STATE GOVERNMENT TO FINANCE THE MULU PROJECT WHEN THE BENEFITS MOSTLY WENT TO ROBERT GENEID AND HIS WIFE.  AT THAT TIME ROBERT AND RAZIAH  ALREADY MANAGED TO INSTIGATE  TAIB  AGAINST HIS SISTER, DATIN AISHAH.

Signs of bad moon rising.

Datuk Dr Hasan Ali's sacking from Pas shows the party is facing a crisis.

Selangor Umno liaison committee deputy chief Datuk Noh Omar said the crisis was not only among its members, but also in its struggle.

"Hasan's sacking as Pas member which resulted in his dismissal as a state exco member showed that Pas members who are staying true to its original struggle no longer have a place in the party.

"Only those who will abide by the demands of Parti Keadilan Rakyat (PKR) and DAP have a place in Pas. Hasan was sacked for trying to uphold the party's fight for an Islamic state.

"This proved that Pas has lost its direction and is now in a dilemma in pursuing its struggle."

Commenting on Menteri Besar Tan Sri Abdul Khalid Ibrahim's earlier hesitation to decide on Hasan's status as a state exco member, Noh said this was because Khalid  was not the "driver" of the state.

"In Selangor, he is not the driver, but a passenger. That is why he had to wait for a signal and had to ask the opinion of all parties before deciding," he added.

Hasan, who was in charge of the Islamic affairs portfolio, was dismissed on Friday after Khalid obtained the consent of the Selangor sultan to remove him as a state exco member following his sacking as Pas member.

The former state Pas commissioner had been unpopular among fellow exco members due to his strong stance on Islamic issues.

Hasan's proposal to ban the sale of alcohol in Muslim majority areas in Selangor was poorly received and he received  even more backlash when he backed the Selangor Islamic Religious Department's (Jais)  raid on Damansara Utama Methodist Church  in August last year for suspected proselytising.

Hasan was said to have sealed his fate when he headed an operation by Jais to check on more than 50 budget hotels and entertainment outlets around the state, which raised the ire of many quarters.

Selangor Pas commissioner Dr Abdul Rani Osman, who was widely tipped to be the one to take Hasan's place in the exco line-up, had earlier admitted that the veteran Pas leader's dismissal would have some impact on Pas Selangor, but did not elaborate further.

On persistent talks of his impending appointment as a state exco member, he said he would leave the decision to Pas central leadership which had yet to submit its list of candidates to replace Hasan to the state government.

On the challenges which awaits him if he is chosen to hold the Islamic Affairs, Malay Customs and Infrastructure and Public Amenities portfolio, Dr Rani said all portfolios came with its own set of problems.

Hasan  is expected to hold a press conference to announce his future plans tomorrow.

Shahrizat 3 week's leave as appropriate-PM

PARIT BUNTAR: Prime Minister Datuk Seri Najib Tun Razak described the decision by Women, Family and Community Development Minister Datuk Seri Shahrizat Abdul Jalil to take a three-week's leave from her ministerial duties as appropriate.

He said the decision would allow the authority to investigate if she was involved in the National Feedlot Corporation (NFC) issue.

"I've discussed with Datuk Seri Shahrizat about the leave, and it is an appropriate decision as it allows the authority to carry out a thorough investigation.

"Datuk Seri Shahrizat said she was willing to be investigated fully. What happens after this will depend on the outcome of the investigation," he told reporters after declaring open the National Farmers, Breeders and Fishermen's Day, here Saturday.

Shahrizat said in a statement on Thursday that she had applied for three weeks' leave, starting Friday.

The NFC issue came to light when the 2010 Auditor-General's Report, released in October, pointed out that the corporation had failed to achieve its objectives.

The NFC is headed by Shahrizat's husband Dr Mohamad Salleh.

Najib also said that the NFC's assets had been frozen for the time being.

The prime minister also said he had asked Deputy Prime Minister Tan Sri Muhyiddin Yassin and Agriculture and Agro-based Industry Minister Datuk Seri Noh Omar to study how best can the NFC issue be resolved.

The NFC is the "meat valley" project in Gemas, Negeri Sembilan aimed at increasing the production of local meat and reducing dependency on import for such product. Bernama

Pembangkang Kian Tersepit Antara Pikul “Biawak Hidup” Dan Kemelut Dalaman Parti

-MediaUMNO

2 men killed in a shootout

KUALA LUMPUR (Jan 12, 2012): The two men killed in a shootout with detectives in Wangsa Maju on Tuesday are remnants of the notorious Mamak Gang.

The men, aged 35 and 45, are believed to be involved in at least 15 robberies, involving losses of more than RM1 million, in Kuala Lumpur. The number of cases they were involved in may be higher in Selangor.

Kuala Lumpur police CID chief SAC II Datuk Ku Chin Wah said the older suspect has 12 previous criminal records and was wanted for five more cases while the other suspect had a record for five past cases.

He said police are looking for the third member of the gang who was armed with a handgun and escaped on foot on seeing his accomplices dead.

He said based on the description given by witnesses, investigators who perused police records have narrowed down the identity of the gunman to several suspects linked to the Mamak Gang.

On Monday, a team of police detectives spotted three men in a car behaving suspiciously near a hypermarket.

When they approached the men, they sped off and a chase ensued before several gunshots rang out of the gang's car. The detectives returned gunfire but the suspects managed to give them the slip.

About 20 minutes later, the driver of the getaway car, who suffered gunshot wounds, crashed the vehicle into the rear of another car driven by a pregnant woman.

On seeing the driver and front passenger, who also suffered gunshot injuries, collapse in the car, the gunman escaped on foot. Witnesses told police they saw the gunman scurrying from the car with a pistol in his hand.

Ku said police believe the survivor had also suffered gunshot wounds during the shootout.

On another matter, police said preliminary results of tests on the debris of three bombs which exploded during the 901 Free Anwar Rally showed that it was home-made pyrotechnics and not commercial or military grade explosives.

Ku confirmed that low-level explosive material were used in the bombs.

Police are working round-the-clock to trace the crooks who had planted the bombs which injured five people including a lawyer.

It was also learnt that police did not have a closed-circuit TV camera footage of the areas where the blasts took place which made identifying the crooks an uphill task.

On Monday, three bombs blew up over a span of 30 minutes in the height of the rally at three different locations close to the KL court complex on Monday soon after word of opposition leader Datuk Seri Anwar Ibrahim being cleared of sodomy charges.

Five people including a lawyer suffered light injuries and several vehicles were damaged in the blasts.

Four of the victims received outpatient treatment while the fifth victim, a man in his 50's who suffered shock as a result of the explosions remains warded at the Kuala Lumpur Hospital.

About Anwar life

The Sodomy II verdict is around the corner and the PKR leader is pushing for a show of support with his party’s call for a mass rally on Monday.

YET another confrontation is brewing between PKR and its leader Datuk Seri Anwar Ibrahim and the authorities as his long-drawn Sodomy II trial climaxes with a verdict by Justice Mohamad Abidin Diah on Monday.

Anwar, who is charged with committing sodomy against his former aide Saiful Bukhari Azlan on June 26, 2008, is mobilising 100,000 people outside the courthouse on the day in an effort to presumably influence the verdict.

That number of people in a small court compound is also a sign of desperation on Anwar’s part, irrespective of whether that actual number of people turn up or not.

It is also an attempt to shake the political establishment, grip the nation’s attention, revive the flagging fortunes of his PKR and try to avert the inevitable.

Anwar has had a long and unrelenting political career that saw him rise to become the second most powerful man as Deputy Prime Minister but then fall from grace ending up as a prisoner only to rise again on his release in 2004, as leader of the Pakatan Rakyat coalition.

He came within touch of the country’s highest post, his lifelong dream, winning 82 seats in parliament in the 2008 general election.

The problem is that the political establishment saw Anwar as an outsider who first used the Islamic reform movement Abim to pressure for change and then when Tun Dr Mahathir Mohamad opened the doors, Anwar abandoned friends and principles and entered Umno.

He made short shrift of his opponents as he climbed up the Umno ladder and was helped along by Mahathir until 1999 when he was to have challenged his own benefactor for the Umno presidency and take the Prime Minister’s post that goes with it.

But he fell foul of powerful political interest groups and was expelled and jailed on corruption and sodomy charges in 1998.

He served his corruption sentence and was acquitted of sodomy and released in 2004 only to put together a loose knit grouping of three parties, including his own PKR, PAS and DAP, to win handsomely against then Prime Minister Tun Abdullah Ahmad Badawi in the 2008 general election.

He managed to combine his grievances, especially the black eye incident, with the grouses of the people and romp home against an ineffective prime minister, winning big but not big enough with just 49% of the popular votes.

After that an eager and impatient Anwar, instead of accepting the people’s verdict and playing his role as Opposition Leader, styled himself as the Prime Minister-in-waiting and launched his Sept 16 gambit that failed miserably when Barisan MPs refused to defect.

His credibility plunged with nearly everyone – the international media, his own supporters and the Malaysian public at large.

In the meantime, Umno saw fit to change horses, urgently retiring Abdullah and putting Datuk Seri Najib Tun Razak in the captain’s seat. Anwar fought very hard to prevent Najib taking over but he failed.

Najib began his political and economic transformation of the nation and three years on is poised to call a general election on the strength of the changes he has introduced principally the repeal of the ISA and other outdated laws, a Peaceful Assembly Bill that allows demonstrations and repeal of Sec 29 of the Police Act that requires police permits.

He is also reforming the election laws and procedures, and has been criss-crossing the country meeting all kinds of people and offering aid and promising that the government is for all the people, not just a few.

Najib is now preparing to introduce a Race Relation law in the March sitting of Parliament that would further undercut the opposition chances at the polls by promising a fair and egalitarian society without discrimination based on race, colour or ethnicity.

Anwar on the other hand has been, as his one-time ally Raja Petra Kamaruddin (RPK) claims, a frequent traveller overseas giving speeches at numerous conferences while his sodomy trial here dragged on with numerous postponements.

Surprisingly, at the trial, Anwar preferred not to testify under oath but gave a speech from the dock decrying government oppression and persecution likening himself to Nelson Mandela.

He also gave up his chance to rebut Saiful thoroughly.

Further sensitive parts of Saiful’s testimony were held in camera, at Anwar’s request. Anwar also promised to call a long list of alibi witnesses but did not do so, weakening his case.

As many, including RPK, have said, Anwar received a fair trial this time compared with 1999.

Whatever the verdict, for Anwar it is just another day and event in a tumultuous career that could have easily floored a lesser man but not this incorrigible optimist.

Star latest Political party in Sabah.

KOTA KINABALU: Datuk Dr Jeffrey Kitingan will be putting on his latest political cap when he opens the Sabah chapter of the State Reform Party (STAR) on Friday.

The 65-year-old Dr Jeffrey will head Sabah STAR after flirting in and out of at least six political parties in the past two decades.

The maverick politician, who joined STAR ahead of the general election after failing to get his pro-tem United Borneo Front registered, described the move as "historical and ground-breaking milestone for the political landscape of Sabah, Sarawak and Malaysia."

He said it was the right time for the political groups in Sabah and Sarawak to unite and seek to safeguard their rights under Malaysia.

"There is no better time to be assertive and persistent than now when the political situation in the country favours Sabah and Sarawak as the kingmakers.

"Sabah and Sarawak leaders should, therefore, unite and leverage their positions to resolve outstanding issues with the federal government, including restoration of the Borneo states' lost rights and autonomy," he said.

The launching of Sabah STAR will be at the Kadazandusun Cultural Hall in Penampang near here.

“It’s for his self-interest and to divert the people’s mind.”
Nallakaruppan, who is  Malaysian Indian United Party (MIUP) president, urged the people not to be  misled by Anwar.

Tinggal lagi Si Karpal Singki pecah ni mana tau pasal tu semua.
